  1. Data Fiduciary Identity: Combe Labs Private Limited ("Mindyard") operates as the Data Fiduciary. Official contact: contact@mindyard.in.
  2. Personal Data Collected: Name, email address, mobile number, date of birth (for minor verification), academic preferences, test attempt history, and AI proctoring frames (only when explicitly opted in, automatically deleted after 30 days).
  3. Purpose of Processing: Account authentication, administering computer-based tests, scoring and analytics, examination malpractice prevention, and technical support.
  4. Protection of Minors (Under 18): Verifiable parental or guardian consent is mandatory before taking proctored assessments. We strictly prohibit commercial tracking, behavioral monitoring, or targeted advertising directed at children.
  5. Data Principal Rights & Erasure: You have the right to access, rectify, or request complete erasure of your personal data and account by emailing contact@mindyard.in.
  6. Right to Nominate: You have the statutory right to nominate an individual to exercise your data rights in the event of death or permanent incapacity. See our Nominee Policy below.
  7. Grievance Redressal & Escalation: Contact our Grievance Officer at contact@mindyard.in. Complaints are resolved within 30 days (maximum 90 days statutory window). If unresolved, you may lodge a complaint with the Data Protection Board of India (DPBI).

  4. बच्चों का संरक्षण (18 वर्ष से कम): 18 वर्ष से कम उम्र के छात्रों के लिए अभिभावक सहमति अनिवार्य है। हम बच्चों की आदतों की ट्रैकिंग, व्यवहारिक निगरानी (Behavioral Monitoring) या विज्ञापनों पर पूर्ण प्रतिबंध लगाते हैं।
  5. डेटा प्रिंसिपल के अधिकार एवं डेटा हटाना: आपको अपने डेटा को देखने, सुधारने, सहमति वापस लेने, एवं अपने खाते व डेटा को पूर्णतः हटाने (Erasure) का अधिकार है। इसके लिए contact@mindyard.in पर ईमेल करें।
  6. नामांकन का अधिकार (धारा 14): मृत्यु या अक्षमता की दुर्भाग्यपूर्ण स्थिति में अपने डेटा अधिकारों के प्रयोग हेतु आपको किसी व्यक्ति को नामांकित करने का वैधानिक अधिकार है। नीचे दी गई नामांकन नीति देखें।

By using, accessing or participating in the Service, you agree to the terms of this privacy policy (the "Privacy Policy"). Capitalized terms not defined in this Privacy Policy have the meanings set forth in the Terms and Conditions. We reserve the right to change our Privacy Policy at any time. If we do this, we will post a notice that we have made changes to this Privacy Policy on the Website for at least 7 days after the changes are posted and will indicate at the bottom of the Privacy Policy the date these terms were last revised. Any revisions to this Privacy Policy will become effective the earlier of (i) the end of the foregoing 7-day period or (ii) the first time you access or use the Service after any such changes. If you do not agree to abide by this Privacy Policy, you are not authorized to use, access or participate in the Service.

Information We Collect

Mindyard Application uploads your Phone Number on its API servers to map your account and mobile number.

When you use the Service you provide us with two types of information: (i) information you submit via the Service and (ii) information regarding your use of the Service collected by us as you interact with the Service.

When you enter the Website, we collect your browser type and IP address. This information is gathered for all Website visitors. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to deny or accept the cookie feature; however, you should note that cookies may be necessary to provide you certain features (e.g., customized delivery of information) available on the Website.

Through the registration process you may provide us with your name, mobile number, email address, date of birth, hometown, and other information that may be requested during the registration process. When you use the Service you may submit information and content to your profile, generate Activity Data through engaging in educational activities on the Service, or send messages and otherwise transmit information to other users. We store this information so that we can provide you the Service and offer personalized features.

Use Of Information Obtained by Combe Labs / Mindyard

We may use your contact information to send you notifications regarding new services offered by Combe Labs Private Limited, Mindyard, and its partners that we think you may find valuable. We may also send you service-related announcements from time to time through the general operation of the Service. Generally, you may opt out of such emails, although we reserve the right to send you notices about your account even if you opt out of all voluntary email notifications.

Profile information is used by us primarily to be presented back to and edited by you when you access the Service and to be presented to other users. In some cases, other users may be able to supplement your profile, including by submitting comments.

We may use aggregate or anonymous data collected through the Service, including Activity Data, for any purpose. This data may be used by us and shared with third parties in any manner.

Right to Data Erasure & Account Deletion

In accordance with Section 12(3) of the Digital Personal Data Protection Act, 2023, users can request the permanent erasure of their personal data and account closure by sending an email from their registered email address to contact@mindyard.in with the subject line "Data Erasure Request - [Your Name/Email]". Upon receipt, our Data Compliance team will acknowledge your request within 48 hours, verify your identity, and permanently anonymize or delete your personal data within 30 days, except where retention is required by applicable law (such as financial or taxation records under the Companies Act or GST regulations).

Sharing Your Personally-Identifiable Information with Third Parties

Combe Labs Private Limited and Mindyard share your personally-identifiable information only in limited circumstances where we believe such sharing is reasonably necessary to offer the Service, legally required or, permitted by you.

Digital Personal Data Protection Act, 2023 (Act No. 40 of 2023) Compliance & Consent

In compliance with the Digital Personal Data Protection Act, 2023 (Act No. 40 of 2023) of India, we process your personal data under the following conditions:

  • General Consent: By registering an account on Mindyard, you provide explicit, specific, and revocable consent for processing your basic signup data (name, email, phone number, and test records) to facilitate online assessment services.
  • AI Proctoring & Biometrics (Explicit Consent): When participating in an AI-proctored test on Mindyard, your device's webcam and browser activity will be monitored. This processes facial frames and screen focus data solely to detect and prevent malpractice. Such data is processed locally where possible, and any uploaded frames are stored securely on our servers. This data is automatically deleted within 30 days after the test evaluation is finalized. You will be prompted for explicit, separate consent right before starting any proctored test.
  • Processing Minor's Data (Under 18): A significant number of our users are preparing for NEET, JEE, and CUET exams and may be under the age of 18. In accordance with the DPDPA, processing a minor's data requires verifiable consent from their parent or lawful guardian. Parents or guardians may review, correct, or request the deletion of the minor's personal data at any time. We strictly do not engage in commercial behavioral tracking, profiling, or targeted advertising directed toward users under the age of 18. Any session monitoring conducted during AI-proctored assessments (such as webcam, microphone, or tab-focus detection) is strictly limited to real-time exam invigilation and academic malpractice prevention, is performed solely upon obtaining verifiable parental or guardian consent, is automatically deleted after 30 days, and is never used to build behavioral profiles or for commercial purposes.
  • Your Rights as a Data Principal: Under the DPDPA, you have the right to access your processed data, correct inaccuracies, withdraw your consent at any time, request data erasure, and nominate another individual to manage your rights in the event of death or incapacity. Right to Nominate & Nominee Policy (Section 14 of DPDP Act, 2023)

Under Section 14 of the Digital Personal Data Protection Act, 2023, every registered user has the statutory right to nominate an individual who shall, in the event of the user's death or permanent medical incapacity, exercise the rights of the user under the Act.

1. How to Designate or Update a Nominee:

You may designate or update your nominee at any time by sending an email from your registered email address to our Grievance Officer at contact@mindyard.in with the subject line "DPDP Nominee Designation - [Your Registered Email/Mobile]" containing:

  • Nominee's full legal name
  • Relationship to the user (e.g., Parent, Spouse, Sibling, Legal Guardian)
  • Nominee's contact information (active email address and mobile number)
  • Copy of government-issued photo ID proof of the nominee (Aadhaar, PAN, Passport, or Voter ID)

2. Exercising Rights as a Nominee or Legal Heir:

In the event of the death or permanent incapacity of a registered user, the designated nominee or lawful legal heir may write to the Grievance Officer at contact@mindyard.in with:

  • Official death certificate issued by the municipal authority (in case of death), or a certified medical certificate of permanent incapacity issued by a registered medical practitioner.
  • Proof of identity of the nominee or legal heir (government-issued photo ID).
  • Legal heir certificate or succession certificate (if a nominee was not pre-designated).

3. Scope of Exercisable Rights & Timeline:

Upon satisfactory verification of documentation, the designated nominee or legal heir may exercise all statutory rights under the DPDP Act, including: (a) requesting access to past test performance reports and certificates, (b) requesting download of study materials or account data, or (c) requesting permanent account closure and erasure of all personal data. All nominee requests are acknowledged within 48 hours and resolved within 30 days (maximum 90-day statutory window under DPDP Rules).

Escalation to Data Protection Board: In accordance with the DPDP Rules, if your grievance is not resolved by our Grievance Officer within the statutory period of 90 days, or if you are dissatisfied with the resolution, you have the right to lodge a complaint with the Data Protection Board of India (DPBI) in such manner as prescribed under the Act.

This Privacy Policy applies solely to information collected by Combe Labs Private Limited via the Service. One such third party is YouTube and by using the Sites or Services, you agree to be bound by the YouTube Terms of Service and also by the privacy policies of Google
